Every jersey design, slogan, product photo and page on jerseyden.shop is meant to be our own work or used with permission, and personalised jerseys carry only text that our customers type. If you believe something on this site copies your copyrighted work, this page explains how to send a notice under the United States Digital Millennium Copyright Act (DMCA), what we do when we receive one, and how a counter-notice works. Notices go to support@jerseyden.shop.
\n
\n
DMCA at a glance
\n
\n
Where to send notices: support@jerseyden.shop, subject line “DMCA notice”.
\n
Postal address: Jersey Den, 1305 Wall St, South Bend, IN 46615, US.
\n
What a notice needs: the six elements listed in section 2.
\n
Our first step: we acknowledge a complete notice and review it promptly; where it is valid, we remove or disable the material.
\n
Counter-notices: possible for anyone who believes material was removed by mistake (section 4).
\n
Trademarks: trademark concerns, such as a team or brand name, are handled under our Intellectual Property Policy.
\n
\n
\n
1. What this policy covers
\n
The DMCA is a US law that gives copyright owners a fast way to ask a website to remove material that infringes their copyright. On jerseyden.shop that could be, for example, a product photo, a graphic printed on a jersey, a piece of text on a page, or an image in a description. Copyright protects creative works such as photographs, illustrations, artwork and writing. It does not protect names, short slogans or numbers on their own; those questions usually belong to trademark law, which our Intellectual Property Policy covers.
\n
Because our custom jerseys are personalised with typed text only (a name of up to 12 characters, a number from 0 to 99 and, on the custom owner jersey, optional sleeve text), customers cannot upload images or artwork to our products. That keeps copyright problems rare, but we still take every notice seriously.
\n
2. How to send a DMCA notice
\n
Send your notice by email to support@jerseyden.shop with “DMCA notice” in the subject line, or by post to the address above. To be complete under 17 U.S.C. § 512(c)(3), the notice must include:
\n
\n
a physical or electronic signature of the copyright owner or of a person authorised to act on the owner’s behalf;
\n
identification of the copyrighted work you believe is infringed, or, if several works are covered by one notice, a representative list;
\n
identification of the material on jerseyden.shop that you believe is infringing, with enough detail for us to find it, ideally the full page URL and a description of the image or text;
\n
your contact information: name, postal address, telephone number and email address;
\n
a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;
\n
a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
\n
\n
A notice that is missing one of these elements may not be actionable. If we receive an incomplete notice, we reply and tell you what is missing so you can complete it.
\n
3. What we do with a complete notice
\n
\n
Acknowledge. We confirm receipt by email, usually within 24 hours on business days.
\n
Review. We locate the material and compare it with the work described in the notice.
\n
Act. If the notice is complete and the material appears to infringe, we remove it or disable access to it. If the material is a product photo or design, the product may be unpublished while the matter is resolved.
\n
Inform. Where material was supplied by someone else, we tell that person about the removal and give them a copy of the notice, with personal contact details removed where appropriate, so they can respond.
\n
Record. We keep a record of notices and actions taken.
\n
\n
4. Counter-notices
\n
If material you supplied was removed because of a DMCA notice and you believe it was removed by mistake or misidentification, you may send a counter-notice to the same email or postal address. Under 17 U.S.C. § 512(g)(3), it must include:
\n
\n
your physical or electronic signature;
\n
identification of the material that was removed and where it appeared before removal;
\n
a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
\n
your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if your address is outside the United States, any judicial district in which Jersey Den may be found), and that you will accept service of process from the person who sent the original notice or their agent.
\n
\n
When we receive a valid counter-notice, we send a copy to the person who sent the original notice. Unless that person tells us they have filed a court action seeking to restrain the activity, we may restore the material in not less than 10 and not more than 14 business days after receiving the counter-notice, as the law provides.
\n
5. Repeat infringement
\n
We do not keep working with anyone who repeatedly supplies infringing material to the store. Where appropriate, we end those relationships and remove their material.
\n
6. Please be accurate
\n
Under 17 U.S.C. § 512(f), anyone who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages. Before sending a notice, consider whether the use could be authorised, for example by a licence, or permitted by law. If you are unsure, you may wish to take legal advice.
\n
7. Our own designs and photos
\n
The Jersey Den name, logo (a dog head wearing a numbered jersey), product designs, slogans such as “GOOD BOY 01” or “NAP CHAMP 09”, product descriptions and page text belong to Jersey Den. Please do not copy them for commercial use. If you see our designs or photos used elsewhere without permission, we would be grateful if you let us know at support@jerseyden.shop.
\n
8. Notices that are not about copyright
\n
Many concerns that reach us are not copyright matters:
\n
\n
Team, league, club, college or brand names: these are trademark questions. Our designs are generic and we do not print real team names; see the Intellectual Property Policy to report a concern.
\n
Privacy: if a page contains your personal information, see our Privacy Policy and email us.
\n
Orders: questions about an order, delivery or return belong in the Help Center; please do not use DMCA notices for order issues, as they are routed differently.
\n
\n
9. What happens when: a simple timeline
\n
\n
Typical handling of a DMCA notice at Jersey Den
\n
\n
\n
Step
\n
Who acts
\n
What happens
\n
\n
\n
\n
\n
Notice sent
\n
Copyright owner or agent
\n
Email or letter with the six elements from section 2.
\n
\n
\n
Acknowledgement
\n
Jersey Den
\n
We confirm receipt, usually within 24 hours on business days, or ask for missing elements.
\n
\n
\n
Review and action
\n
Jersey Den
\n
We find the material and, for a valid notice, remove or disable it and tell you.
\n
\n
\n
Supplier informed
\n
Jersey Den
\n
If someone else supplied the material, we send them the notice so they can respond.
\n
\n
\n
Counter-notice (optional)
\n
Supplier of the material
\n
A valid counter-notice is forwarded to the original sender.
\n
\n
\n
Restoration (only if no court action)
\n
Jersey Den
\n
Material may be restored 10 to 14 business days after a valid counter-notice.
\n
\n
\n
\n
10. Examples from a jersey store
\n
To make the policy concrete, here is how we would look at a few kinds of reports. These are illustrations, not legal advice, and every real notice is reviewed on its own facts.
\n
A photographer finds their dog photo on a product page
\n
Product photos on Jersey Den are meant to be our own. If a photographer sends a complete notice showing that a lifestyle picture on a product page is their photograph, used without a licence, we remove the picture and replace it with our own image. The product itself can stay on sale, because the jersey design is not the issue.
\n
An illustrator recognises artwork on a jersey
\n
Our jersey designs are built from lettering, stripes, numbers and simple shapes such as a paw print or a box outline. If an illustrator believes a design copies their artwork, the notice should identify the original artwork and the product. If the notice is valid, we stop selling the design while the matter is resolved.
\n
A team says a customer’s typed name matches its name
\n
That is a trademark question, not a copyright one. We do not print real team, league, club or athlete names in the first place, and any such text found in an order is stopped before printing. Concerns like this are handled under our Intellectual Property Policy.
\n
Someone copied a Jersey Den slogan
\n
Short phrases such as “COUCH MVP” are generally not protected by copyright on their own. If you think another seller has copied our product photos or the full artwork of a design, tell us; we may contact them. If you are the other seller and believe our use of a phrase or image is a problem, write to us and we will look at it in good faith.
\n
11. Fair use, licences and public material
\n
Some uses of copyrighted material are allowed without permission, for example under a licence the copyright owner granted, or under fair use. When we review a notice, we consider whether such a reason might apply, and we ask senders to do the same before writing. If you granted a licence that has since ended, please say so in the notice and include the relevant dates.
\n
12. Tips for a faster review
\n
\n
Link to the exact product page or page section, not just the home page.
\n
Describe the image or text in words (“the second gallery photo, a beagle on a sofa”), because product pages can change.
\n
Attach or link to the original work, or explain where it was first published.
\n
Use one email per notice and keep the subject line “DMCA notice” so it is routed correctly.
\n
If you are an agent, say who you represent and include proof of authorisation if you can.
\n
\n
13. Contact
\n
DMCA notices and counter-notices: support@jerseyden.shop, subject “DMCA notice” or “DMCA counter-notice”.
